Rubbish Removal Ilford Service Terms and Conditions
These Terms and Conditions set out the basis on which Rubbish Removal Ilford provides rubbish removal and waste collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing a booking.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
Customer means the person, business or organisation requesting the rubbish removal or waste collection service.
Company means Rubbish Removal Ilford, the provider of the services described in these terms.
Services means any waste collection, rubbish clearance, bulky item removal, garden waste removal, construction waste removal or related services provided by the Company.
Waste means any rubbish, refuse, junk, unwanted items or materials collected as part of the Services, excluding items that cannot legally be collected or disposed of by the Company.
Booking means an order placed by the Customer for the Services, whether made by telephone, email, online form or any other method accepted by the Company.
2. Scope of Services
The Company provides rubbish removal and waste collection services for residential, commercial and other premises. Services typically include loading, transport and disposal or recycling of waste, subject to applicable laws and regulations.
The exact details of the Services, including the type and estimated volume of waste to be collected, access arrangements, time and date of collection, and any specific requirements, will be agreed at the time of Booking.
The Company reserves the right to refuse to collect any waste that is not accurately described at the time of Booking or that falls outside the scope of permitted waste, including hazardous or prohibited materials.
3. Booking Process
3.1 Bookings may be made by telephone, email or through any online booking facility operated by the Company. The Customer must provide accurate and complete information, including:
a. Contact details and the collection address.
b. Description and estimated volume or weight of the waste.
c. Details of access to the property, including any parking restrictions or limitations.
d. Preferred collection date and time window.
3.2 The Company will provide an estimate or quote based on the information supplied. This estimate may be subject to change if, on arrival, the actual volume, weight, type or location of the waste differs from the description provided at the time of Booking.
3.3 A Booking is only confirmed when the Company accepts the Booking and communicates confirmation to the Customer. The Company reserves the right to decline any Booking at its discretion.
3.4 The Customer warrants that they are the owner of the waste to be removed or are authorised by the owner to arrange its removal.
4. Access and Customer Obligations
4.1 The Customer must ensure that:
a. The Company has safe and reasonable access to the waste and the collection point at the agreed time.
b. Any required parking arrangements or permits are in place to allow the Company’s vehicle to park close to the collection address.
c. The waste is clearly identified and segregated if necessary, and is not mixed with hazardous or prohibited items.
4.2 If the Company is unable to access the waste due to the Customer’s fault, or if the waste is not available for collection at the agreed time, the Company may charge a wasted journey fee or a partial service fee to cover its time and costs.
4.3 The Customer agrees not to include any hazardous, illegal or prohibited waste in the collection, including but not limited to asbestos, clinical or medical waste, chemicals, solvents, batteries, gas cylinders, explosives or any materials that require specialist handling or disposal.
5. Pricing, Estimates and Additional Charges
5.1 Prices for the Services are generally based on the volume, weight, type and location of the waste, as well as the time required to complete the job.
5.2 Any initial quotation or estimate provided is based on the Customer’s description of the waste and the conditions at the collection site. If, upon arrival, the waste volume or type differs from the original description, or access to the site is more difficult than advised, the Company may revise the price accordingly.
5.3 If additional labour, time or equipment is required due to inaccurate information provided by the Customer, obstruction, poor access or other unforeseen circumstances beyond the Company’s control, the Company may apply additional charges. These will be explained to the Customer before the work proceeds wherever reasonably possible.
5.4 All prices are stated exclusive of any applicable taxes unless otherwise specified. Any taxes, fees or charges imposed by law will be added to the final invoice.
6. Payments and Invoicing
6.1 Payment is due in full on completion of the Services, unless otherwise agreed in writing prior to the collection.
6.2 The Company may require a deposit or full prepayment at the time of Booking, particularly for larger collections, commercial work or where specialist arrangements must be made.
6.3 The Company accepts payment by the methods it specifies from time to time, which may include cash, card payment, bank transfer or other electronic payment methods.
6.4 For approved business or account customers, payment terms may be agreed in writing, typically with payment due within a specified number of days from the invoice date. The Company reserves the right to carry out credit checks and to withdraw credit facilities at any time.
6.5 If the Customer fails to make payment by the due date, the Company may charge interest on the overdue amount at a reasonable commercial rate until payment is received in full, and may suspend further Services until all outstanding amounts are settled.
7. Cancellations and Rescheduling
7.1 The Customer may cancel or reschedule a Booking by giving reasonable notice to the Company.
7.2 If the Customer cancels a Booking with less than 24 hours notice before the scheduled collection time, the Company reserves the right to charge a cancellation fee to cover administrative and scheduling costs.
7.3 If the Company arrives at the collection address and is unable to complete the Service due to circumstances within the Customer’s control, the Company may charge a call-out or wasted journey fee.
7.4 The Company will use reasonable efforts to meet agreed collection times, but all times are estimates and may be affected by traffic, weather or operational factors. The Company is not liable for any loss or damage arising from minor delays, but will keep the Customer informed and reschedule where necessary.
8. Waste Handling and Disposal
8.1 The Company will collect, transport and dispose of waste in accordance with applicable environmental and waste management laws and regulations.
8.2 Once the waste is loaded onto the Company’s vehicle, it becomes the property and responsibility of the Company, and the Customer relinquishes all title and interest in the waste.
8.3 The Company aims to recycle or recover materials where possible, but does not guarantee that any particular item or proportion of waste will be recycled.
8.4 The Customer must not request the Company to dispose of waste illegally, and must not include any material that cannot lawfully be collected or disposed of as part of the Services.
9. Customer Warranties and Indemnities
9.1 The Customer warrants that:
a. They have full authority to arrange the removal of the waste.
b. The waste is accurately described and does not include any hazardous, prohibited or illegal materials.
c. The premises are safe and suitable for the Company’s personnel and vehicles to access for the purpose of providing the Services.
9.2 The Customer will indemnify the Company against any claims, losses, damages, liabilities, costs or expenses arising from:
a. Any breach of these Terms and Conditions by the Customer.
b. The inclusion of hazardous or prohibited waste in the collection.
c. Any damage or injury caused by unsafe conditions at the Customer’s premises, where such conditions were unknown to the Company.
10. Liability and Limitations
10.1 The Company will exercise reasonable care and skill in providing the Services. However, the Company is not liable for any loss or damage arising from:
a. Inaccurate, incomplete or misleading information provided by the Customer.
b. Pre-existing defects or conditions at the Customer’s premises.
c. Minor cosmetic damage that may occur when removing large or bulky items from confined spaces, provided the Company has taken reasonable care.
10.2 If the Company is found liable for any loss or damage, its total liability to the Customer, whether in contract, tort or otherwise, shall be limited to the amount paid or payable for the specific Services giving rise to the claim, except where such limitation is not permitted by law.
10.3 Nothing in these Terms and Conditions excludes or limits the Company’s liability for death or personal injury caused by its negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot legally be excluded or limited.
10.4 The Company is not liable for indirect or consequential losses, including loss of profits, loss of business, loss of opportunity or any similar loss.
11. Damage to Property
11.1 The Customer must inform the Company of any features, fixtures or fittings that could be particularly vulnerable to damage, such as fragile flooring, narrow staircases or delicate wall finishes.
11.2 The Company will take reasonable care to avoid damage when removing waste from the Customer’s premises. If damage is caused directly by the Company’s negligence, the Company may repair the damage or compensate the Customer for the reasonable cost of repair, subject to the liability limitations set out in these terms.
12. Waste Regulations and Compliance
12.1 The Company operates in accordance with relevant waste management regulations, including duties relating to the transport, treatment and disposal of controlled waste.
12.2 The Customer agrees to cooperate with the Company in any reasonable request for information required to comply with legal obligations, such as describing the nature of the waste or confirming its origin.
12.3 The Customer acknowledges that certain waste streams must be handled separately and may incur additional charges, for example, electrical equipment, fridges and freezers, tyres, mattresses or other regulated items.
12.4 If the Company suspects that any waste is hazardous or prohibited, it may refuse to collect it, request additional information, or require specialist arrangements at additional cost.
13. Force Majeure
13.1 The Company is not liable for any failure or delay in performing its obligations where such failure or delay results from events, circumstances or causes beyond its reasonable control, including but not limited to severe weather, road closures, accidents, strikes, lock-outs, fuel shortages, acts of government or other similar events.
13.2 In such circumstances, the Company may suspend the Services for the duration of the event or agree a new collection date with the Customer.
14. Data Protection and Privacy
14.1 The Company will collect and process personal data about the Customer for the purposes of managing Bookings, providing the Services, handling payments and maintaining business records.
14.2 The Company will handle personal data in accordance with applicable data protection laws and will take reasonable steps to keep such data secure.
14.3 The Customer consents to the Company using their contact details to communicate about Bookings and the Services. The Customer may request that the Company stops using their details for marketing purposes at any time.
15. Variations to Terms
15.1 The Company may update or amend these Terms and Conditions from time to time. The version in force at the time of the Booking will apply to that specific Service.
15.2 Any changes to these terms requested by the Customer will only be valid if agreed in writing by an authorised representative of the Company.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or with the Services, shall be governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided.
17. General Provisions
17.1 If any provision of these Terms and Conditions is held to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect.
17.2 No failure or delay by the Company in exercising any right or remedy provided under these Terms and Conditions or by law shall constitute a waiver of that or any other right or remedy.
17.3 The Customer may not assign or transfer any of their rights or obligations under these Terms and Conditions without the Company’s prior written consent. The Company may assign or transfer its rights and obligations to another suitable service provider, provided this does not materially reduce the level of service offered to the Customer.
17.4 These Terms and Conditions, together with any written confirmation of Booking and any agreed variations, constitute the entire agreement between the Customer and the Company in relation to the Services.
